We will provide you information regarding Sale, Purchase, Rent of the properties through Developers, Estate Consultants, Owners, etc. In order to use the PostPropertyOnline.com ("Portal"), you may registered as a member of the Portal ("Member") by providing your true and correct information as required to be provided to us in our registration process.
PostPropertyOnline.com shall have absolute discretionary powers to add and delete the kind of information/services provided any time with or without the alteration in this Service Agreement, which shall be effective upon sending notice of such change to you.
PostPropertyOnline.com may at its sole discretion from time to time offer you variety of features, information’s and facilities for the service which you are required related to Immovable properties.
AGREEMENT
This is a Contract/Agreement between you and PostPropertyOnline.com, having its office address at Shop No-89, Kamdhenu Shopping Centre, Lokhandwala Complex, Andheri (West), Mumbai-400 053, Maharashtra, India.
This Contract is effective from the date when you first start using PostPropertyOnline.com and/or first start registration on PostPropertyOnline.com and shall continue until terminated by either party expressly by giving written notice. Any notice of termination of this Contract by yourself shall be treated as null and void if you start using this PostPropertyOnline.com service after sending such notice.
PostPropertyOnline.com provides services relating to all real estate/property and without any specific warranty of any specific result/outcome.
PostPropertyOnline.com may modify this Agreement from time to time. Any alteration in this Contract term shall be effective on sending an alert email to that effect to your email address as provided by you from time to time. You are supposed to check the provisions of this Contract regularly to update yourself accordingly. Your use of PostPropertyOnline.com site implies your acceptance of change in this Contract as effected by PostPropertyOnline.com from time to time.
MEMBERSHIP
By registering your profile on PostPropertyOnline.com you choose to become a member of PostPropertyOnline.com.
Membership is not automatic : The right of admission vests with PostPropertyOnline.com. You become a member upon due acceptance of your Profile by PostPropertyOnline.com.
Length of Membership : You continue to be a member of PostPropertyOnline.com till:
PostPropertyOnline.com discharges its obligations to you by the rendering of its services to you; or The termination of the membership by either PostPropertyOnline.com or by you.
Privity of Membership : Your Membership is only for personal use. It is not to be assigned, transferred or licensed so as to be used by any other person/entity. Our site does not vouch for or subscribe to the claims and representations made by advertisers regarding particulars of property and real estate transactions.
Online Conduct : You are responsible for the content and information [including profile and photographs] you post or transmit through PostPropertyOnline.com services. You will not post or transmit any content or information [in whatever form they may be contained] that is defamatory, blasphemous, abusive, obscene, sexually oriented, profane, intimidating, illegal or in violation of the rights of any person, including intellectual property rights. No content or information shall contain details or particulars of any of PostPropertyOnline.com competitors, including their contact details. You will not use either your online or offline membership as a platform for any kind of promotional campaign, solicitation, advertising or dealing in any products or services or transmit any chain letters or junk mails.
PostPropertyOnline.com reserves the right to modify your content if any prohibitive or objectionable content is found, or in the case of your contact details being entered in irrelevant fields. PostPropertyOnline.com may also modify the profile for other reasons not mentioned herewith.
You will not post or transmit any content, information or trademarks without the prior consent of the person holding its proprietary or licensed rights. PostPropertyOnline.com will not in any way be responsible or answerable to any action brought by any person arising out of your acts as described above.
PostPropertyOnline.com reserves the right but is not obligated, to edit, delete, eclipse or withhold display of such content or information as it deems fit in the light of the rules prescribed above.
SUBSCRIPTION CHARGES
The applicable rate of the Subscription charges for the Service provided shall be such as mentioned in the “My Subscriptions” page or as may be prescribed by us from time to time.
Liability for the payment of Subscription Charges shall accrue from the Date of Commencement of Service.
All individual Users who registered or make postings of information at PostPropertyOnline.com for the purpose of buying/selling/renting the property shall be exempted from the application of this clause.
A) MODE OF PAYMENT
Where Subscription Charges accrues
it shall be payable at or within such time as stated in the invoice(s)
issued by us to the User. All the payments to be made to us shall
be by way of Demand Draft/Pay Order, payable at Mumbai, and drawn
in favour of " GREENWOOD ESTATE AND INVESTMENT CONSULTANT"
The Subscription Charges shall be paid by the User on demand. In case the user disputes the same for any reason whatsoever, he/she shall make the payment towards the Subscription Charges accrued subject to the decision by us on the dispute. In the event of We deciding the dispute in the User’s favour, We shall refund to the User any excess amount paid by the User free of interest.
Any delay in the payment by the User of any sums due under this Agreement, We shall have the right to charge interest on the outstanding amount from the date the payment became due until the date of final payment by the User.
B) CANCELLATION
PostPropertyOnline.com shall reserve the exclusive right to cancel/modify any content whatsoever from being published or reflected on its website or in any other mode. The cancellation charges payable to the User shall be at the applicable rates laid down in the cancellation and refund policy.
INTELLECTUAL PROPERTY RIGHTS AND SITE RESTRICTIONS
All content on this Portal, including, but not limited to text, images, illustrations, audio clips, and video clips, is protected by copyrights, trademarks, service marks, and/or other intellectual property rights (which are governed by Indian and worldwide copyright laws and treaty provisions, privacy and publicity laws, and communication regulations and statutes), and are owned and controlled by PostPropertyOnline.com or its affiliates, or by third party content providers, merchants, sponsors and licensors (collectively "Providers") that have licensed their content or the right to market their products and/or services to PostPropertyOnline.com. Content on this portal, operated, licensed or controlled by the Providers is solely for your personal, non-commercial use. b) Unauthorized access to or alteration of your transmissions or data

INDEMNIFICATION

You are under an obligation to report any misuse or abuse of the PostPropertyOnline.com. If you notice any abuse or misuse of the Portal or any thing, which is in violation of this Agreement, you shall forthwith report such violation to PostPropertyOnline.com by writing to us.
Any false complaint made by a Member shall make such Member liable for termination of his / her membership without any refund of the subscription fee and any Member making/indulging directly or indirectly in making false complaint against any other registered member/potential member then PostPropertyOnline.com shall be entitled to recover all loss, costs, expenses, damages etc which may be incurred by PostPropertyOnline.com due to action taken on the basis of such false information/complaint.
TERMINATION
Either party to this agreement may terminate this Agreement by giving prior notice of 30 days in writing.
It shall be on the discretion of the PostPropertyOnline.com that the period of notice of 30 days may be waived or a shorter period of notice may be accepted in writing from the User.
However, the PostPropertyOnline.com irrespective of above may terminate this Agreement with immediate effect, without prior notice to the User and without assigning any reason/s whatsoever
PRIVACY
PostPropertyOnline.com is concerned about the safety and privacy of all its users. PostPropertyOnline.com is not supposed to intentionally monitor or disclose any private e-mail message or address information unless required by any law, or order of court or any statutory authority. You agree to respect the privacy and confidentiality of others.
DISPUTES
Any dispute/claim in relation to
this agreement or in connection therewith shall be filed with opposite
party within 12 months from the date when the claim first could
be filed or cause of action arises, whichever is earlier. If there
is any dispute about or involving the Portal and/or its services
by using the PostPropertyOnline.com you further agree that the laws
of India will govern the disputed matter. You agree to the exclusive
jurisdiction of the courts of MUMBAI, India.
